OUR COMMITMENT TO PRIVACY

MotionDSP (Company) knows that you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our privacy policy. By visiting MotionDSP’s vReveal site, or using any of our vReveal products or services, you acknowledge that you accept the practices and policies outlined in this Privacy Policy.

WHAT DOES THIS PRIVACY POLICY COVER?

This Privacy Policy covers MotionDSP’s treatment of all information that MotionDSP gathers when you use the vReveal.com site or when you use vReveal products or services (“User Information”). This policy does not apply to the practices of companies that Company does not own or control, or to individuals that Company does not employ or manage.

WHAT INFORMATION DOES COMPANY COLLECT?

By using the vReveal.com site and vReveal products, users agree that MotionDSP may collect aggregate information, individual information, and personally identifiable information, as defined below. MotionDSP may share aggregate information and individual information with other parties. MotionDSP shall not share personally identifiable information with other parties, except as described in the policy below.

"Aggregate information" is information that describes the habits, usage patterns, and demographics of users as a group but does not describe or reveal the identity of any particular user.

"Individual information" is information about a user that is presented in a form distinguishable from information relating to other users but not in a form that personally identifies any user or enables the recipient to communicate directly with any user unless agreed to by the user in advance of such communication. This information may be used to improve MotionDSP's products and online sites, for internal marketing studies, or simply to collect demographic information about MotionDSP's users.

MotionDSP may use customer contact information provided by users to send information about MotionDSP, including news about product updates, contests, events, and other promotional materials, but only if the users agree to receive such communications. Except in the cases described below, MotionDSP will not share personally identifiable information with any third party unless the user agrees to such disclosure in advance. "Personally identifiable information" consists of a user's name, email address, physical address, or other data about the user that enables the recipient to personally identify the user. While MotionDSP collects personally identifiable information on a voluntary basis, for certain products and online sites, MotionDSP's collection of personally identifiable information may be a requirement for access to the product or site. Personally identifiable information will be processed and stored by MotionDSP in databases situated in the United States. MotionDSP may allow third parties performing services under contract with MotionDSP to access stored information but such access shall only be to the extent necessary to provide those services. In those instances, the third party will be bound by the terms of this privacy policy.

Personally identifiable information protected under this privacy policy and collected from users may be done in conjunction with associates under agreement with MotionDSP. If providing the information is a requirement of usage, the user may decline to use that particular service or product. When possible, MotionDSP will make a reasonable effort to direct users to the privacy polices of these associates. MotionDSP's privacy policy does not extend to associates of MotionDSP.

Furthermore, external websites and companies with links to and from MotionDSP's online sites and products may collect personal information about users. MotionDSP's privacy policy does not extend to these external websites and companies. Please refer directly to these companies and websites regarding their privacy policies.

MotionDSP may release personally identifiable information to comply with court orders or laws that require us to disclose such information

Information Collected Automatically:

We receive and store certain types of information whenever you interact with our Web site or Company services, or use vReveal desktop software. Company automatically receives and records information on our server logs from your browser including your IP address and the page you requested.

MotionDSP also stores information on a user's hard drive that is used in conjunction with use of MotionDSP products. For premium users, this includes a unique authorization key that is either entered by the user or downloaded automatically during product purchase/registration. This authorization key is used to identify a user as valid and allow access to MotionDSP's products. Information regarding billing, your account, your Internet connection and the MotionDSP software installed on your computer are uploaded to the server in connection with your use of the vReveal software. vReveal automatically generates and submits to MotionDSP bug reports upon a crash or other fault in the MotionDSP software. This automatically generated bug report information may include information about other software or hardware on a user's system. MotionDSP does not associate and store the automatically generated bug report information with personally identifiable information. Any bug reporting information manually submitted by users (e.g. through the GetSatisfaction user forum) may be associated and stored with personally identifiable information.

Generally, our software automatically collects usage information, such as the use of various components of vReveal, similar to TV ratings that indicate how many people watched a particular show. We also collect and store aggregate information about what features of vReveal are used by our users, and the frequency. We use this information to improve the product’s features and workflow.

As part of this use of information, we may provide aggregate information to our partners about how our customers, collectively, use our site and vReveal software. Company never discloses aggregate information to a partner in a manner that would identify you personally.

What About Cookies?

Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your browser to enable certain features of our service. With the exception of the main login identification cookie, Company cookies only exist on your hard drive while you are logged in as a subscriber and are deleted upon logout. It is required for subscribers that cookies be allowed while logged in to the Company service.

SHARING OF USER INFORMATION RECEIVED

We neither rent nor sell your User Information to anyone. We share your Registration Information only with our affiliates as required to deliver you services as described below.

Affiliated Businesses We Do Not Control: We are affiliated with certain businesses and work closely with them. Normally, you can easily recognize when an affiliated business is associated with your transaction, and we will share customer information that is related to such transactions with that affiliated business.

Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Examples include storing and serving video and still image files/sending email/removing repetitive information from customer lists/analyzing data/providing marketing assistance/processing credit card payments/and providing customer service. Unless we tell you differently, Company’s agents do not have any right to use Registration Information we share with them beyond what is necessary to assist us. You hereby consent to our sharing of Registration Information for the above purposes.

Business Transfers: In some cases, we may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that are transferred. Moreover, if Company, or substantially all of its assets were acquired, or in the unlikely event that Company goes out of business or enters bankruptcy, customer information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Company may continue to use your User Information as set forth in this policy.

Protection of Company and Others: We may release User Information when we believe in good faith that release is necessary to comply with that law; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of Company, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

With Your Consent: Except as set forth above, you will be notified when your User Information may be shared with third parties, and will be able to prevent the sharing of this information.

OUR COMMITMENT TO DATA SECURITY

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.

Your Company account personal information is protected by a password for your privacy and security. You need to prevent unauthorized access to your account and personal information by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account.

During our free consumer beta period, we are offering our services for free, and do not collect any credit card information from Users. When we implement that feature in the future, we will use industry-standard 128-bit Secure Socket Layer (SSL) software to protect the security of your personal information during transmission. This software will encrypt all of the information you input.

OUR COMMITMENT TO CHILDREN'S PRIVACY

Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our website from those we actually know are under 13, and no part of our website is structured to attract anyone under 13.

WHAT CHOICES DO I HAVE?

If you do not wish to receive email or other mail from us, please click the unsubscribe link that is included at the bottom of our emails. Please note that if you do not want to receive legal notices from us, such as this Privacy Policy, those legal notices will still govern your use of the Company Web site, and you are responsible for reviewing such legal notices for changes.

CHANGES TO THIS PRIVACY POLICY

Company may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make changes in the way we use User Information, we will endeavor to notify you by sending an email to the email address currently associated with your account. The most recent version of this Privacy Policy will also be available on our corporate website at http://www.vreveal.com/privacy. You agree that any new version of our Privacy Policy that is posted and announced on the Company website will apply to your use regardless of whether you received this email notification.
